Terms of Service

These Terms of Service govern your use of the Calder & Co website and your purchase of any products from us. By browsing this site or placing an order, you agree to these terms. Please read them before you buy.

In these terms, "we", "us" and "our" mean Calder & Co, and "you" means you, the customer.

1. Eligibility

You must be at least 18 years old, or the age of majority where you live, to place an order. By ordering you confirm that you meet this requirement and that the payment method you use belongs to you or that you are authorised to use it.

2. Products and descriptions

We work hard to describe and photograph our pieces accurately. Even so, colours can appear slightly different between screens, and small variations in finish, tone and dimensions are normal in jewellery. Measurements given are approximate.

Our pieces are fashion jewellery made from plated brass, stainless steel, cord and beads, unless a product page states otherwise. They are not precious metal and are not sold as fine jewellery or as an investment.

3. Not a medical device

Some of our pieces are described as fidget, anxiety or wellbeing accessories. They are decorative accessories only. They are not medical devices and are not intended to diagnose, treat, cure or prevent any condition. Nothing on this site is medical advice. If you are struggling with anxiety or your mental health, please speak to a qualified professional.

4. Pricing and availability

All prices are shown in the currency selected at checkout and may change without notice. Products are subject to availability, and we may limit quantities or discontinue any item.

Despite our best efforts, a small number of items may occasionally be mispriced or listed in error. If we discover an error in the price or description of something you have ordered, we will contact you before dispatch and give you the option to continue at the correct price or cancel for a full refund. We reserve the right to cancel any order placed at an incorrect price, even after an order confirmation has been sent.

An order confirmation email is an acknowledgement that we have received your order. It is not acceptance of it. A contract between us is formed only when we dispatch the goods.

5. Orders we may decline

We reserve the right to refuse or cancel any order at our discretion, including orders that appear fraudulent, orders placed with a payment method we cannot verify, orders from customers with a history of excessive returns or disputes, orders that appear to be for resale, and orders to addresses we cannot ship to safely. Where we cancel an order, we refund it in full.

6. Payment

Payment is taken at checkout through Shopify's secure encrypted checkout. We do not see or store your full card details. You confirm that the payment information you provide is accurate and that you are authorised to use it.

7. Shipping and returns

Delivery timeframes, shipping costs and customs charges are set out in our Shipping Policy. Returns, refunds, exchanges and cancellations are set out in our Refund Policy. Both policies form part of these terms.

8. Chargebacks and payment disputes

If there is a problem with your order, please contact us at support@shopcalderco.com before contacting your bank. We reply within 24 hours and can almost always resolve things faster than a formal dispute.

Where a chargeback is filed without prior contact, we will contest it and provide the issuing bank with the order record, tracking information, delivery confirmation and any correspondence. Filing a chargeback does not suspend or extend the timeframes in our Refund Policy. We may decline future orders from customers who file disputes we consider to be unfounded.

9. Accuracy of your information

You are responsible for providing accurate and complete delivery and contact details. We are not liable for orders that fail to arrive because of incorrect information supplied at checkout.

10. Use of this site

You agree not to use this site for any unlawful purpose, to attempt to gain unauthorised access to it, to interfere with its operation, to scrape or copy its content for commercial use, or to submit false or misleading information. We may terminate your access for breaching these terms.

11. Intellectual property

All content on this site, including product photography, written descriptions, brand names, logos and page design, is owned by us or used with permission and is protected by copyright and trade mark law. You may not reproduce, republish or use it commercially without our written consent.

12. Customer submissions

If you send us reviews, photographs, comments or other material, you grant us a non-exclusive, royalty-free, worldwide licence to use, reproduce and publish it in connection with our business. You confirm that anything you send is your own and does not infringe anyone else's rights. We are under no obligation to publish or keep any submission.

13. Third-party links

This site may link to third-party websites and services that we do not control. We are not responsible for their content, products or practices, and a link is not an endorsement.

14. Disclaimer of warranties

This site and everything on it is provided "as is" and "as available". To the fullest extent permitted by law, we make no warranties of any kind, express or implied, regarding uninterrupted or error-free service, or that this site is free of viruses or other harmful components. This does not limit any statutory rights you have as a consumer.

15. Limitation of liability

To the fullest extent permitted by law, our total liability in connection with any order is limited to the amount you paid for that order. We are not liable for indirect, incidental, special or consequential losses, including loss of profit, loss of opportunity, or disappointment where an item does not arrive in time for a specific occasion.

Nothing in these terms excludes or limits our liability for death or personal injury caused by negligence, for fraud, or for anything else that cannot lawfully be excluded.

16. Indemnity

You agree to indemnify and hold harmless Calder & Co and its suppliers and partners from any claim or demand arising out of your breach of these terms or your violation of any law or the rights of a third party.

17. Events outside our control

We are not liable for any failure or delay in performing our obligations where that failure or delay results from events beyond our reasonable control, including carrier delays, customs action, strikes, extreme weather, supplier failure, and interruptions to power or communications networks.

18. Privacy

Your personal information is handled in accordance with our Privacy Policy.

19. Changes to these terms

We may update these terms at any time by posting a revised version on this page. The version in force at the time you place an order is the version that applies to that order. Please check back periodically.

20. Severability

If any provision of these terms is found to be unlawful or unenforceable, that provision will be severed and the remaining provisions will continue in full force.

21. Governing law

These terms are governed by the laws of the Province of Ontario, Canada, and the federal laws of Canada applicable there, without regard to conflict of law rules. This does not deprive you of the protection of any mandatory consumer law of the country in which you live.
